This Privacy Policy describes how buy.gib.shopping (the “Site” or “we”) collects, uses, and discloses necessarily your Personal Identifiable Information (PII) when you visit or make a purchase from the Site.

We carefully analyse what types of information we need to provide our services, and we try to limit the information we collect to only what we really need. Where possible, we delete or anonymize this information when we no longer need it. When building and improving our products, our engineers work closely with our privacy and security teams to build with privacy in mind. In all of this work our guiding principle is that your information belongs to you, and we aim to only use your information to your benefit. This includes examples such as providing your chosen Delivery Service your name, address and telephone number so they can deliver your purchase or service.

 

If a third party requests your personal information, we will refuse to share it unless you give us permission or we are legally required to do so. When we are legally required to share your personal information, we will tell you in advance, unless we are legally forbidden. Such cases may be due to fraud for example.

Many of the merchants and partners listed on Gib.shopping do not have the benefit of a dedicated privacy team like our processing partners, and it is important to us to help them meet their privacy obligations. To do this, we try to build our products and services so they can easily be used in a privacy-friendly way. We also provide detailed FAQs, documentation and whitepapers covering the most important privacy topics, and respond to privacy-related questions we receive.

 

Collecting Personal Information

When you visit the Gib.shopping, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support or subscribe to any of our services which we may use to better our services and marketing. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. Device information

Order information

  • Examples of Personal Information collected: name, billing address, shipping address, payment information (including credit card numbers), email address, and phone number.
  • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: shared with our processing partner.
  • Gib.shopping does not have access to your payment information (including credit card numbers). This is processed by our processing partners and depends on your chosen method of payment.  Gib.shopping limits itself to providing a marketplace pooling all retail and service providers for ease of the consumer.
  • Gib.shopping is a Special Ops (Gibraltar) product and part of the Gib dot family. A list of the affiliated domains can be found on Gib.holiday and may be used to inform you of Gibraltar related activities, events, products, services, etc.

Minors

The Site is not intended for individuals under the age of 16 years of age. We do not intentionally collect Personal Identifiable Information (PII) from children. If you are the parent or guardian and believe your child has provided us with Personal Information, please contact us at the address below to request deletion.

Physical business can take payments over the phone, over the internet and many other channels unable to identify the age of the buyer. Gib.shopping cannot be made liable if a minor purchases items restricted by age such as tabacco, alcohol products or other age-restricted products. The onus is on the vendor to check for ID when the item is being picked up, or the delivery/ shipping service provider when the item is being delivered.

Sharing Personal Information

We share your Personal Information with service providers to help us provide our services and fulfil the purchase and/or delivery of products and/or services you have purchased, as described above. For example:

  • Gib.shopping must share your address details so that delivery/ shipping providers can delivery your purchase.
  • We may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
  • Gib.shopping will not share your information with entities outside of the Gib dot family of services per the aforementioned.

 

Behavioural Advertising

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. For example:

Automatic decision-making

We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

Our processing partners uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

Services that include elements of automated decision-making include:

  • Temporary denylist of IP addresses associated with repeated failed transactions. This denylist persists for a small number of hours.
  • Temporary denylist of credit cards associated with denylisted IP addresses. This denylist persists for a small number of days.

 

Why we process your information

We generally process your information when we need to do so to fulfil a contractual obligation (for example, to process your subscription payments, to pay for your purchase or requested services), or where we or partners we work with needs to use your personal information for a reason related to their business (for example, to provide you with a service). European law calls these reasons “legitimate interests.” These “legitimate interests” include but are not limited to:

  • preventing risk and fraud,
  • answering questions or providing other types of support,
  • helping merchants find and use apps through our app store,
  • providing and improving our products and services,
  • providing reporting and analytics,

One of the ways in which we are able to help merchants  is by using techniques like “machine learning” (European law refers to this as “automated decision-making”) to help us improve our services. When we use machine learning, we either: (1) still have a human being involved in the process (and so are not fully automated); or (2) use machine learning in ways that don’t have significant privacy implications (for example, reordering how apps might appear when you visit the app store).

 

Selling Personal Information

Our Site sells DOES NOT sell personal information.

 

Your rights over your information

We believe you should be able to access and control your personal information no matter where you live. Depending on how you use Gib.shopping, you may have the right to request access to, correct, amend, delete, port to another service provider, restrict, or object to certain uses of your personal information (for example, direct marketing). We will not charge you more or provide you with a different level of service if you exercise any of these rights; however our level of service may be affected if the information provided is inaccurate, fake or missing.

If you buy something from a A Gib.shopping platform, and wish to exercise these rights over information about your purchase, you need to directly contact the merchant you interacted with. We are only a processor on their behalf, and cannot decide how to process the information you have provided them. As such, if you contact Gib.shopping, we can only forward your request to them to allow them to respond. We will of course help our merchants to fulfil these requests by giving them the tools to do so and by answering their questions.

Please note that if you send us a request relating to your personal information, we have to make sure that it is you before we can respond. In order to do so, we may ask to see documentation verifying your identity, which we will discard after verification.

If you would like to designate an authorised agent to exercise your rights for you, please email us from the email address we have on file for you and copy the authorised agent including your express permission for them to act on your behalf. If you email us from a different email address to that on file, we cannot determine if the request is coming from you and will not be able to accommodate your request. In your email, please include the name and email address of your authorised agent.

You also have the right to contact your local data protection authority, namely the Gibraltar Regulatory Authority at any time — https://www.gra.gi/data-protection.

Finally, because there is no common understanding about what a “Do Not Track” signal is supposed to mean, we don’t respond to those signals in any particular way. You do however have the option to 'Unsubscribe' by clicking links in our correspondence or emailing us so we remove you from our systems and mailing lists.

GDPR

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. Although Gib.shopping is a Gibraltar based company, we work with and process data about individuals across the world. To operate our business, we may send your personal information outside of Gibraltar or your country of residence. This data may be subject to the laws of the countries where we send it. When we send your information across borders, we take steps to protect your information, and we try to only send your information to countries that have strong data protection laws. This data may be part of, but is not limited to; your payment process, data to your credit card providers, online banking, etc.

Transfers outside of Europe and Switzerland

If you are in Europe or Switzerland, your personal information is controlled by our Irish affiliate. Your information may be sent to other locations and to service providers who may be located in other regions, including Canada and the United States. When we send your personal information outside of Europe, we do so in accordance with European law.

If you are in Europe or Switzerland, should we need to send your personal information to Canada it is protected under Canadian law, which the European Commission has found will adequately protect your information. If we need to send any personal information outside of Canada this information is protected by contractual commitments that are comparable to those provided in Standard Contractual Clauses.

Finally, while we do what we can to protect your information, we may at times be legally required to disclose your personal information (for example, if we receive a valid court order).
